Welcome to Viktoria Bezghin Art. By accessing or purchasing from this website, you agree to the following Terms of Service. Please read them carefully before placing an order.

1. General Information

This website is operated by artist Viktoria Bezghin. Throughout the site, “we”, “us”, and “our” refer to the artist. The store provides custom hand-painted artwork, prints, and handmade art products. By using the site, you agree to comply with these Terms of Service.

2. Eligibility to Purchase

To place an order, you must:

  • Be at least 18 years old or have parental consent
  • Provide accurate, complete, and up-to-date information
  • Use a valid payment method accepted by Shopify

3. Custom Artwork Orders

Most items in the store are custom-made, hand-painted portraits created from photos provided by the customer.

By placing an order for custom artwork, you acknowledge that:

  • Each portrait is an artistic interpretation and may differ from the photo
  • The artist does not create poses from imagination
  • You must supply 2–6 clear photos, including one showing the desired pose
  • Your photos are used solely to create the artwork

Work begins only after the artist confirms the received photos. Failure to send photos may delay or prevent completion of the artwork.

4. Rights to Submitted Photos

By submitting photos, you confirm that:

  • You own the rights to the photos or have permission to use them
  • You authorize the artist to use the photos strictly for creating your artwork
  • You understand the artist is not responsible for copyright issues arising from customer-submitted photos

5. Intellectual Property

All completed artwork remains the intellectual property of the artist, including copyright and reproduction rights.

The customer receives the physical artwork but does not receive rights to:

  • Reproduce or print the artwork
  • Sell or distribute copies
  • Digitally modify or commercialize the artwork

Reproduction requires written permission from the artist.

6. Use of Artwork in Portfolio

The artist may photograph completed paintings and use the images for:

  • Portfolio
  • Website gallery
  • Social media
  • Marketing materials

If you prefer your artwork not to be used publicly, you may opt out using the Rights Release Form.

7. Pricing & Payments

Prices for products are subject to change at any time without notice. All payments are processed securely through Shopify’s payment systems. We reserve the right to:

  • Refuse any order
  • Limit quantities
  • Correct pricing errors

8. Shipping & Delivery

Shipping times shown at checkout are estimates and may vary based on location, season, and postal delays.

Once an order is shipped, delays caused by the carrier are outside the artist’s control. Lost packages will be investigated with the carrier.

International customers are responsible for customs duties and import fees.

9. Cancellations, Returns & Refunds

Due to the nature of custom artwork:

  • Returns and exchanges are not accepted
  • Refunds are not available
  • Cancellations are accepted only before painting begins

10. Accuracy of Information

We do our best to display product descriptions and images accurately. However, differences in color, texture, and lighting may occur between the original artwork and digital photos. The artist is not responsible for variations caused by screen displays.

11. Prohibited Uses

You agree NOT to use the website or products for:

  • Illegal or fraudulent activity
  • Reselling or distributing the artwork without permission
  • Copyright infringement
  • Uploading harmful or offensive content

12. Limitation of Liability

The artist is not liable for damages resulting from:

  • Delayed shipping due to postal carriers
  • Incorrect or insufficient photos provided by the customer
  • Allergic reactions to materials or packaging
  • Customer misuse or mishandling of artwork

13. Changes to Terms

We reserve the right to update or change these Terms of Service at any time. The most current version will always be posted on this page.
